O Supremo Tribunal Federal (STF) confirmou a constitucionalidade da Lei Federal n\u00ba 14.385\/2022, que regulamenta a devolu\u00e7\u00e3o aos consumidores dos tributos cobrados a mais pelas distribuidoras de energia el\u00e9trica. A decis\u00e3o assegura que os valores obtidos pelas empresas em a\u00e7\u00f5es judiciais tribut\u00e1rias sejam repassados integralmente aos consumidores, e n\u00e3o incorporados ao patrim\u00f4nio das concession\u00e1rias.<\/div>\n<\/div>\n

A Advocacia-Geral da Uni\u00e3o (AGU) representou a Uni\u00e3o e a Ag\u00eancia Nacional de Energia El\u00e9trica (Aneel) na defesa da norma. O entendimento do STF foi firmado nesta quinta-feira (14), ao julgar a A\u00e7\u00e3o Direta de Inconstitucionalidade (ADI) n\u00ba 7324, apresentada pela Associa\u00e7\u00e3o Brasileira das Distribuidoras de Energia El\u00e9trica (Abradee).<\/div>\n<\/div>\n

Durante o julgamento, o advogado da Uni\u00e3o Jo\u00e3o Pedro Carvalho destacou que o governo atuou \u201cna defesa dos consumidores de energia el\u00e9trica e na restitui\u00e7\u00e3o integral de valores, da maneira que a Aneel j\u00e1 fazia administrativamente e foi posta no texto da lei\u201d.<\/div>\n<\/div>\n

Em sustenta\u00e7\u00e3o oral, o advogado da Uni\u00e3o Raphael Ramos Monteiro de Souza lembrou que a legisla\u00e7\u00e3o busca garantir o direito dos consumidores e o equil\u00edbrio contratual entre as distribuidoras e o poder p\u00fablico.<\/div>\n<\/div>\n

\u201cO Congresso Nacional atuou de forma leg\u00edtima e proporcional, evitando o enriquecimento sem causa por parte das empresas. A norma \u00e9 compat\u00edvel com a Constitui\u00e7\u00e3o e assegura equidade nas rela\u00e7\u00f5es econ\u00f4micas\u201d, afirmou Souza.<\/div>\n<\/div>\n

Na decis\u00e3o final, o STF determinou que as distribuidoras poder\u00e3o deduzir os valores gastos com tributos incidentes na restitui\u00e7\u00e3o e com honor\u00e1rios advocat\u00edcios referentes \u00e0s a\u00e7\u00f5es espec\u00edficas sobre o tema.<\/div>\n<\/div>\n

Para garantir seguran\u00e7a jur\u00eddica, o Tribunal fixou o prazo de prescri\u00e7\u00e3o de dez anos para a devolu\u00e7\u00e3o desses valores, contados a partir da efetiva restitui\u00e7\u00e3o do ind\u00e9bito \u00e0s distribuidoras ou da homologa\u00e7\u00e3o definitiva da compensa\u00e7\u00e3o realizada.<\/div>\n<\/div>\n
