Segundo o advogado, a CP n\u00e3o tinha validade devido \u00e0 falta de provas concretas contra o prefeito. Ele enfatizou que a suposta confiss\u00e3o apresentada era apenas um documento assinado, sem valor probat\u00f3rio para a Comiss\u00e3o.<\/p>\n<p>Dr. Jefferson explicou que o documento em quest\u00e3o era um acordo de n\u00e3o persecu\u00e7\u00e3o criminal, assinado pelo prefeito com o Minist\u00e9rio P\u00fablico (MP), com o objetivo de esclarecer as acusa\u00e7\u00f5es no \u00e2mbito do MP. Ele destacou que tal acordo n\u00e3o poderia produzir efeitos fora daquele processo espec\u00edfico e que a assinatura foi feita seguindo orienta\u00e7\u00f5es dos advogados do prefeito.<\/p>\n<p>Com base nesses argumentos, o advogado de defesa sustentou que a Comiss\u00e3o Processante carecia de fundamenta\u00e7\u00e3o legal para prosseguir com a cassa\u00e7\u00e3o, j\u00e1 que as provas apresentadas n\u00e3o eram suficientes para incriminar Marcio Burguinha.
