O projeto de emenda \u00e0 Constitui\u00e7\u00e3o, votado pela comiss\u00e3o nesta quarta-feira (13), faz um aceno contr\u00e1rio a discuss\u00e3o dos ministros do STF sobre o tema<\/h2>\n<\/div>\n

A Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a (CCJ) do Senado aprovou nesta quarta-feira (13) a proposta de emenda \u00e0 Constitui\u00e7\u00e3o (PEC) que\u00a0\u00a0criminaliza a posse e o porte de drogas il\u00edcitas em qualquer quantidade.\u00a0O texto foi aprovado em vota\u00e7\u00e3o simb\u00f3lica, sem contagem nominal de votos.<\/p>\n

Agora, a PEC segue para o plen\u00e1rio do Senado e, se aprovada, ser\u00e1 enviada para a an\u00e1lise da C\u00e2mara dos Deputados.<\/p>\n

Quatro senadores pediram para registrar voto contr\u00e1rio ao texto: Marcelo Castro (MDB-PI), Fabiano Contarato (PT-ES), Jaques Wagner (PT-BA) e Humberto Costa (PT-PE).<\/p>\n<\/div>\n

STF e Senado discutem o tema<\/h3>\n

No \u00faltimo 6 de mar\u00e7o, o\u00a0\u00a0Supremo Tribunal Federal (STF) retomou a discuss\u00e3o em plen\u00e1rio sobre\u00a0a constitucionalidade do artigo 28 da Lei das Drogas (11.343 de 2006),\u00a0que aborda o transporte e armazenamento para uso pessoal.<\/p>\n

O julgamento, no entanto, foi\u00a0\u00a0suspenso depois que o ministro da Corte Dias Toffoli pediu vista\u00a0(mais tempo para an\u00e1lise). At\u00e9 o momento, a vota\u00e7\u00e3o est\u00e1 em\u00a0 5 a 3 pela descriminaliza\u00e7\u00e3o. O prazo da vista \u00e9 de 90 dias.<\/p>\n

\u201cA vingar a tese da inconstitucionalidade do artigo 28 [da Lei das Drogas], o que se estar\u00e1 fazendo \u00e9 descriminaliza\u00e7\u00e3o da conduta numa invas\u00e3o de compet\u00eancia do Congresso Nacional\u201d, declarou Pacheco.<\/p>\n

No entanto, o presidente do Senado concordou que cabe \u00e0 Justi\u00e7a definir as diretrizes de quantidade para distinguir usu\u00e1rio de traficante.<\/p>\n
