A Justi\u00e7a do Distrito Federal aceitou uma queixa-crime apresentada pelo ex-presidente\u00a0Jair\u00a0Bolsonaro\u00a0(PL) contra o\u00a0\u00a0hacker Walter Delgatti Neto\u00a0pelo crime de den\u00fancia. Com isso, ser\u00e1 iniciada uma a\u00e7\u00e3o penal e Delgatti se tornar\u00e1 r\u00e9u.<\/p>\n

A queixa foi feita devido ao\u00a0depoimento de Delgatti na Comiss\u00e3o Parlamentar Mista de Inqu\u00e9rito (CPMI) do dia 8 de janeiro,\u00a0em agosto do ano passado. O hacker afirmou que\u00a0Bolsonaro teria solicitado a ele que assumisse a autoria de um grampo contra o ministro do\u00a0Supremo Tribunal Federal\u00a0(STF)\u00a0Alexandre de Moraes, algo que a defesa do ex-presidente nega. A defesa de Delgatti ainda n\u00e3o se pronunciou sobre a decis\u00e3o.<\/p>\n

O juiz Omar Dantas Lima, da 3\u00aa Vara Criminal de Bras\u00edlia, considerou que foram apresentadas a “prova da materialidade” e os “ind\u00edcios de autoria” de Delgatti. O hacker tem 10 dias para apresentar sua defesa.<\/p>\n

Os advogados de Bolsonaro solicitaram uma pena mais severa para Delgatti por ter feito as declara\u00e7\u00f5es na “presen\u00e7a de in\u00fameras pessoas”. O crime de cal\u00fania prev\u00ea reclus\u00e3o de seis meses a dois anos, com acr\u00e9scimo de um ter\u00e7o se ocorrer “na presen\u00e7a de v\u00e1rias pessoas, ou por meio que facilite a divulga\u00e7\u00e3o da cal\u00fania”, al\u00e9m de pagamento de multa.<\/p>\n

Em seu depoimento,\u00a0\u00a0Delgatti afirmou que Bolsonaro mencionou que havia obtido um “grampo” de Moraes e que era necess\u00e1rio que ele assumisse a autoria.<\/p>\n

“Segundo ele (Bolsonaro), eles haviam conseguido um grampo, que era t\u00e3o esperado \u00e0 \u00e9poca, do ministro Alexandre de Moraes. Que teria conversas comprometedoras do ministro, e ele precisava que eu assumisse a autoria desse grampo”, disse Delgatti na sess\u00e3o da CPMI, ocorrida em 17 de agosto.<\/p>\n

“Eu era o hacker da Lava-Jato, n\u00e9. Ent\u00e3o, seria dif\u00edcil a esquerda questionar essa autoria, porque l\u00e1 atr\u00e1s eu teria assumido a “Vaza-Jato”, que eu fui, e eles apoiaram.
