O Congresso Nacional derrubou, em sess\u00e3o conjunta nesta quinta-feira (14), o veto do presidente Luiz In\u00e1cio Lula da Silva (PT) ao trecho de uma proposta que estabelece a tese do marco temporal para a demarca\u00e7\u00e3o de terras ind\u00edgenas. Com a derrubada do veto, o texto ser\u00e1 promulgado.<\/p>\n

A derrota do governo aconteceu por ampla margem nas duas casas legislativas. Na C\u00e2mara, 321 deputados votaram para derrubar o veto, contra 137 que votaram para mant\u00ea-lo. No\u00a0Senado, foram 53 votos para derrubar e 19 para manter.<\/p>\n

A derrubada do veto contou com articula\u00e7\u00e3o da\u00a0Frente Parlamentar da Agropecu\u00e1ria, que tem um total de\u00a0374 integrantes, entre deputados e senadores.<\/p>\n

A tese do marco temporal, que agora passa a valer, limita a demarca\u00e7\u00e3o de terras ind\u00edgenas ao prever que os povos origin\u00e1rios t\u00eam direito a ocupar apenas as terras que ocupavam ou disputavam at\u00e9 5 de outubro de 1988, quando a Constitui\u00e7\u00e3o Federal foi promulgada.<\/p>\n

Ap\u00f3s a derrubada do veto, o tema pode ser judicializado, j\u00e1 que o argumento do governo para vetar a tese \u00e9 de que ela seria inconstitucional.\u00a0\u00a0O\u00a0Supremo Tribunal Federal\u00a0(STF) tamb\u00e9m j\u00e1 descartou a tese.<\/p>\n

Esta \u00e9 a segunda derrota do governo nesta quinta, j\u00e1 que o\u00a0veto ao\u00a0projeto de lei que prorroga a desonera\u00e7\u00e3o da folha de pagamento para 17 setores da economia tamb\u00e9m foi derrubado\u00a0\u00a0pelos parlamentares.<\/p>\n
