O ministro\u00a0Alexandre de Moraes, do\u00a0Supremo Tribunal Federal, criticou nesta quinta-feira (23) a PEC que limita os poderes do\u00a0STF. O magistrado declarou que a Constitui\u00e7\u00e3o determina que o Judici\u00e1rio tenha independ\u00eancia e que a Corte n\u00e3o tem \u201ccovardes\u201d e \u201cmedrosos\u201d.<\/p>\n

“Essa Corte n\u00e3o se comp\u00f5e de covardes e nem de medrosos. A constitui\u00e7\u00e3o garantiu a independ\u00eancia do poder judici\u00e1rio proibindo qualquer altera\u00e7\u00e3o constitucional que desrespeite essa independ\u00eancia e desrespeite a separa\u00e7\u00e3o de poderes”, afirmou o ministro.<\/p>\n

Moraes disse que discutir ideias e aprimoramentos das institui\u00e7\u00f5es s\u00e3o fundamentais para a democracia, no entanto, que n\u00e3o se pode aceitar \u201cintimida\u00e7\u00f5es\u201d que colocam em risco \u00e0 independ\u00eancia doo Supremo.<\/p>\n

“A discuss\u00e3o de ideias, o aprimoramento das institui\u00e7\u00f5es s\u00e3o discuss\u00f5es importantes instrumentos da democracia, mas n\u00e3o quando escondem insinua\u00e7\u00f5es, intimida\u00e7\u00f5es e ataques \u00e0 independ\u00eancia do poder judici\u00e1rio, principalmente, a independ\u00eancia deste Supremo Tribunal Federal”, comentou.<\/p>\n

Moraes ainda usou a pandemia da Covid-19 para defender decis\u00f5es monocr\u00e1ticas dos ministros do STF. Na avalia\u00e7\u00e3o dele, vidas foram salvas no auge do coronav\u00edrus no Brasil.<\/p>\n

“Durante a pandemia, a defesa da vida, a defesa da sa\u00fade, a defesa da vacina\u00e7\u00e3o, v\u00e1rias decis\u00f5es urgentes durante a pandemia foram dadas por medidas liminares dos relatores. A necessidade urgente de medidas liminares, depois referendadas imediatamente pelo colegiado, salvou in\u00fameras vidas durante a pandemia”, concluiu.<\/p>\n

Os ministros Lu\u00eds Roberto Barroso\u00a0e\u00a0Gilmar Mendes tamb\u00e9m criticaram a aprova\u00e7\u00e3o da PEC.<\/p>\n

PEC<\/h2>\n

A PEC n\u00e3o permite decis\u00f5es monocr\u00e1ticas de ministros que cancelem a efic\u00e1cia de leis ou a\u00e7\u00f5es dos presidentes da Rep\u00fablica, da C\u00e2mara, do\u00a0Senado\u00a0e tamb\u00e9m do Congresso Nacional.<\/p>\n

A proposta foi uma resposta dos senadores a julgamentos que ocorreram recentemente no Supremo. Deputados e senadores passaram a acusar os ministros de discutirem temas que, na avalia\u00e7\u00e3o deles, devem ficar nas m\u00e3os do Congresso, como a legaliza\u00e7\u00e3o do aborto e da maconha.<\/p>\n
