O presidente do\u00a0Senado, Rodrigo Pacheco, declarou nesta ter\u00e7a-feira (21) que a PEC (Proposta de Emenda \u00e0 Constitui\u00e7\u00e3o) que visa limitar decis\u00f5es monocr\u00e1ticas do\u00a0Supremo Tribunal Federal\u00a0n\u00e3o representa uma “afronta” nem uma “retalia\u00e7\u00e3o” ao Poder Judici\u00e1rio.<\/p>\n

Pacheco negou que a proposta tenha motiva\u00e7\u00e3o eleitoreira, rejeitando associa\u00e7\u00f5es com as\u00a0elei\u00e7\u00f5es\u00a0municipais de 2024.<\/p>\n

\u201cN\u00e3o h\u00e1 nenhum tipo de afronta, nem tampouco, nenhum tipo de retalia\u00e7\u00e3o, absolutamente. O que n\u00f3s estamos buscando fazer no Congresso Nacional \u00e9 o aprimoramento da legisla\u00e7\u00e3o e o aprimoramento da Constitui\u00e7\u00e3o Federal para garantir que os poderes funcionem bem\u201d, comentou.<\/p>\n

\u201cNosso intuito no Senado e o meu, especialmente, como presidente do Senado, \u00e9 o de sempre buscar aprimorar o sistema de Justi\u00e7a, garantir as prerrogativas do Judici\u00e1rio, tornar o Judici\u00e1rio mais eficiente e essa \u00e9 a raz\u00e3o de ser dessa proposta de emenda \u00e0 Constitui\u00e7\u00e3o. N\u00f3s jamais nos utilizar\u00edamos de uma altera\u00e7\u00e3o constitucional com esse intuito de enfrentamento entre as duas casas”, completou.<\/p>\n

A PEC em quest\u00e3o busca restringir as decis\u00f5es monocr\u00e1ticas, limitando as possibilidades de ministros do\u00a0STF<\/a>\u00a0e desembargadores tomarem decis\u00f5es individuais.<\/p>\n

Al\u00e9m disso, o texto estabelece regras para abreviar os prazos dos pedidos de vista, quando ministros solicitam mais tempo para analisar uma a\u00e7\u00e3o.<\/p>\n

O contexto da PEC surge em resposta a decis\u00f5es do STF sobre temas considerados pelo Congresso como de sua compet\u00eancia, como o marco temporal para demarca\u00e7\u00e3o de terras ind\u00edgenas e a descriminaliza\u00e7\u00e3o do porte de maconha.<\/p>\n

Em outubro, a proposta foi aprovada em 40 segundos na Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a do Senado.<\/p>\n

Rodrigo Pacheco afirmou desconhecer a opini\u00e3o dos ministros do STF sobre o tema, destacando a independ\u00eancia do Senado.<\/p>\n

A PEC, apresentada pelo senador Oriovisto Guimar\u00e3es e relatada por Esperidi\u00e3o Amin, impede decis\u00f5es individuais de ministros de suspenderem leis ou atos dos presidentes da Rep\u00fablica, da C\u00e2mara, do Senado e do Congresso Nacional.<\/p>\n

Entre as altera\u00e7\u00f5es propostas, a PEC sugere que haja no m\u00e1ximo dois pedidos de vista por julgamento, concedendo prazo coletivo de at\u00e9 6 meses. Pode haver renova\u00e7\u00e3o por mais 3 meses se existirem votos divergentes.<\/p>\n
